1. Service Description

MenuScore (“the Service”) is a menu engineering and pricing analysis tool operated by 808 Online Marketing, LLC (“we,” “us,” or “our”), located at 30025 Alicia Pkwy #20-92, Laguna Niguel, CA 92677. The Service uses artificial intelligence to analyze restaurant menu photos, estimate food costs, and provide pricing recommendations.

2. AI-Generated Estimates Disclaimer

All food cost estimates, recipe breakdowns, pricing recommendations, and financial projections provided by MenuScore are AI-generated estimates only.

  • Food costs are estimated based on average wholesale prices for your selected region. Actual costs vary based on your specific suppliers, volumes, contracts, and market conditions.
  • Recipe estimates are generic approximations. They do not reflect your actual recipes, portion sizes, or preparation methods.
  • Menu item classifications (Winner, Hidden Gem, Underpriced, Losing Money) are based on industry heuristics and estimated data, not your actual sales figures.
  • Monthly opportunity and profit projections are rough estimates and should not be relied upon as financial forecasts.

3. User Responsibility

You acknowledge and agree that:

  • You are solely responsible for verifying all data, estimates, and recommendations provided by the Service before making any business decisions.
  • You should input your actual food costs and recipes to get accurate results. The Service provides tools for you to correct and refine AI estimates.
  • Any menu pricing changes, menu modifications, or business decisions you make based on the Service are entirely your responsibility.
  • You should consult with a qualified financial advisor or accountant for significant business decisions.

4. Limitation of Liability

808 Online Marketing, LLC is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost revenue, lost profits, or business interruption resulting from menu pricing decisions made using the Service's recommendations. The Service is provided “as is” without warranties of any kind, either express or implied.

5. Subscription and Payments

  • Free tier: Limited to basic menu photo analysis with estimated food costs.
  • Pro subscription: $99/month, billed monthly. Cancel anytime.
  • Payments are processed securely through Stripe. We do not store your payment information on our servers.
  • You may cancel your subscription at any time from your dashboard. Access continues until the end of your current billing period.

6. Data and Privacy

  • Menu photos you upload are processed by OpenAI's API for analysis. By using the Service, you consent to this processing.
  • We store your menu analyses, uploaded invoices, and account information securely using Supabase.
  • We do not sell your data to third parties.
  • Demo sessions (free analyses without an account) are stored anonymously for service improvement.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Upload content that infringes on intellectual property rights.
  • Attempt to reverse-engineer, decompile, or exploit the Service.
  • Use automated tools to scrape or abuse the Service.

8. Changes to Terms

We reserve the right to modify these terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
